KKK wins lawsuit against bakery for discrimination


A Georgia court has ruled in favor of the KKK in a discrimination lawsuit.

A Georgia court has ruled in favor of Marshall Saxby, the Grand Wizard of a local KKK chapter, in a lawsuit stemming from two years ago when a local bakery denied him service.

The three judge panel concluded unanimously that the bakery had violated civil rights laws by discriminating against Saxby when they refused to sell him a cake for his organization’s annual birthday party.

Elaine Bailey, who owns Bailey Bakeries, refused to bake a cake for the ceremony because it violated her religious beliefs.

Saxby filed the lawsuit claiming that Bailey’s refusal of service was discriminatory against his religious beliefs.

The case is similar to the recent decision in New Mexico where a court has ruled that a photographer discriminated against a gay couple for refusing to provide them service.

Bailey said in a prepared statement, “it’s a sad day when bigots have to be treated equally before the law. If they can discriminate against people, then surely I cannot be forced to support their beliefs by providing them services against my will.”

Saxby was very happy with the outcome, stating “the law says that it’s wrong to discriminate against people if you run a business, and that means she was wrong in discriminating against our organization by refusing us service.”

People on both sides of the issue have had varying remarks.

One man stated “I am against anti-discrimination laws. Freedom means people are able to do what they wish with their lives and property. Society can punish bad behaviors in a market, but the power to take away from someones life as if it did not belong to them is frightening.

Another person familiar with the case responded “This is not the same as denying service to someone based on the color of their skin or sexual preference. This was a choice by the owner of the bakery to not serve someone based on their bigoted lifestyle, and there’s nothing wrong with that.”

Many wonder that if she had simply lied about her reasoning, would this have even been an issue. That leaves the question to the public, do they want discrimination to happen out in the open where people can pinpoint it, or do they want it to operate a cloaked manner where it happens but it’s hard to tell who is doing it?

      Thank You for the Native American perspective!! I’m also waiting for the entire Native American population to demand the removal of the American Flag. If the Confederate Flag is a symbol of slavery to the African-American community, then isn’t the American Flag a similar symbol to Native Americans?? Did not the Federal Gov attempt to eradicate ALL Native Americans? Do not Japanese-Americans have a similar complaint after being forced into internment camps??

    It’s ironic that when the aggrieved person is discriminated on the basis of sexual preference (they don’t serve queers), people get upset. But when a customer makes a different choice (to be in the KKK) the standard isn’t important anymore.

    Some will say being queer isn’t a choice. But if homosexuality ISN’T a choice, then it’s a medical condition which may be susceptible to being cured. What? Queers don’t want to be cured? Isn’t that a little like someone with leprosy saying they don’t want to be cured?

    Point is, it’s got to be one way or the other. Either it’s a lifestyle choice (and no different from the KKK) or it’s a medical condition (and we should be looking for a cure).

      Your argument assumes that homosexuality is pathological, i.e akin to disease. If you don’t start with a flawed premise,
      you might be more effective at articulating your point. A more neutral and apt analogy is to compare homosexuality to left handedness. It was once considered to be aberrant and in need of correction, even though it is inherited. Now most rational people would acknowledge that, even if it can be “corrected” through training, why should it be. The expression of my genetics is not yours to judge or fix. Spend your energy becoming more informed and less judgmental. It would be a far better use of your time.

    By law, every business must be willing to supply their service to all comers (as opposed to a private club, which naturally may admit only those they want). That’s the law. It’s part of what operating a public business means.

    And, yes, that includes bigots (so long as they behave themselves and do not cause a disturbance). It is just as illegal to deny service to someone for being a KKK member as it is to deny him service because he is Black or Jewish or communist or whatever.

    This has nothing to do with endorsing his views. It has to do with giving people their civil rights, even if they have disgusting views. If you are not willing to serve all customers, you shouldn’t be operating a business — just like you should not be operating a business if you don’t feel like obeying with food safety regulations.

    Why this is even an issue I have no idea. The judges clearly made the right choice, and they did not “endorse” the KKK in any way.

    I don’t agree with the decision. People have the right to associate with whoever they wish when ever and where ever.. The idea of a”Public” place is a phony construct created by liberals to give them the power to shove their moral beliefs down our throats. Government and its functions are the only Public activities. Everything else is private and should be treated as such. Our country and race relations would be a lot more advanced if we respected the right to associate. People have a right to love or hate anybody they wish for any reason. Who am I to judge what is truly in a man’s heart or mind. It is called freedom. We need to get back to it.

      The way things are today, the only group it’s “safe” to discriminate against is white, heterosexual males. The government does that all the time by giving “preferences” to everyone else. Not only does government encourage this discrimination – it demands it. But then, recently the government has only been reflecting the desires of the majority voting block: Women. That’s why our debt is $18 trillion, we borrow 40% of every Federal dollar spent and we’re facing $200 trillion in unfunded mandates over the next 50 years.

      The 19th Amendment was the biggest legislative mistake in the history of America. It won’t be long until we see the results: Complete economic collapse.

        I agree with you on the women in the workplace to some extent. However, without an independent income, it’s difficult to be “independent”. “Independence” is at the heart of the lie women have sold themselves. “I am woman, hear me roar… but just in case, I want government welfare programs to subsidize me in a social safety net.”

        Men DO have an option to not work. That’s what you’re seeing today. I recently read, “Men on Strike: Why Men Are Boycotting Marriage, Fatherhood, and the American Dream – and Why It Matters” which chronicles the decrease in men going to college, entering the work force and getting married. As the male role is widely denigrated (even in commercial advertising it’s seen as acceptable to disparage men), men are retreating from the traditional roles. In general, the trend is towards video games and porn as a replacement – with jobs that provide for the bare necessities and no attempt at higher education.

        I call it the “pussification” of America… but then, I’m not politically correct.

    Regardless of the law, how would you answer the following, “If a business didn’t want to serve a black member of the NAACP would you have a problem with this, cry racism and demand the business owner kowtow?”.     The way I look at it, a business that discriminates against customers/employees may just hurt itself. Imagine the world’s best salesman is black – and a business won’t hire him because of that. Doesn’t he just cross the street and work for the business’ competitor? Don’t customers who feel unwelcome just go across the street to buy from the competition?

    On the other hand, if the black guy is a lazy good-for-nothing bum, should the company be forced to hire him? Should money be stolen from taxpayers to subsidize him? If the black customers are routinely stealing, shouldn’t a store owner be allowed to ban them?

If the former, then queers should be looking for treatment. If the latter, then there’s nothing wrong with discriminating against them that isn’t also problematic when discriminating against members of the KKK, who, after all, have only made their “lifestyle choice”.

    My self and my family have been educated by the finest colleges and private Ivy League colleges in this nation, And 80% of my scholastic competition was from female students, who were at the top of our class. I am extremely aware of how much more socially and emotionally evolved women in general are. Of course they must first be allotted the rights to vote and read, which they were given 300 yrs. later than their male counterparts. And look at them go! All in the last 40 yrs!! I work with women every day in a highly powered political science arena. The more educated you become the more you will see what is oh so obvious to the elite, and that the majority of your minimally so called “researched” opinions about women in power, is just another opinion of one person and one author. He obviously is as warped, insecure, uneducated and threatened as you.

      Except that men and women do think differently. Research rather conclusively shows that women are responsible for racking up the majority of our National Debt. It’s also true that while the majority of college students today are female, women are still a distinct minority in engineering, physics and most other scientific and mathematical areas. Is this because they don’t want these in-demand, high-paying jobs? Or because they can’t do the work?

      The College Entrance Examination Board had a real problem with this biological difference. It seems that their Physics Level II Achievement Test was clearly not “gender neutral”. The males were doing much better than the women. Significant effort went into trying to determine why this was and to gender-norm the test. What CEEB found was that women did as well, or better, on problems that involved rote application of computation to a known formula. But in problems where they were required to think abstractly, they failed miserably. In the final analysis, CEEB was faced with a decision: They could gender-norm the test (so that women men scored within the same distribution), or they could test the ability to do physics. They could not do both.

Not trying to justify the Klan but as a cartoon was trying to show back in the early to mid 1990’s in a Rainbow Coalition newsletter: More blacks have been killed at the hand of other blacks than all of the blacks killed by neo-nazi and Klan members combine. The cartoon showed Klan members hiring black street and drug gang members to kill off each other. And that’s not to mention Plan Parenthood that was started by a member of the nazi party from the 1930’s and ’40’s who originally started it to kill blacks that the democrats today so proudly support. Do your homework. Since 1990, more blacks have been killed by other blacks than “all” of the blacks killed by the Klan/neo-nazi’s members since 1900.

        Given the gross dysfunction of black society (51% of all homicides by 13% of the population), would you really want it to be 10 times larger? Too big a portion of the black population in American are ignorant savages. Among all groups of people, the percentage of violent criminals is highest among those who weren’t wanted as children. Better to abort them than to lock them up 16 years later for killing someone.

    There are a lot of nutty judges who should be removed and Congress has the power to remove them. In my lawsuit against the 1967 California ban on carrying loaded firearms in public the district court judge ruled that minorities can’t bring civil rights lawsuits challenging criminal laws.

    Remember, this is what the Feds believe. Let them have their cause, we need only strip them of their purpose. In other words, those fighting for racial equality can do that. Equal rights for homosexuals fine fight away, religious freedom put the gloves on and step to the center of the ring. But all of you remember, if you lose the fight your cause will not go forward. Don’t even think about what motivated you to the ring at the start. “Equality for all.” You have the right to be gay, you have the right to be a white supremist and you have the right to fight to be treated as any other human being. The Feds want this because as duress I’m sitting here they know they must increase the peasant class and decrease the middle class. Blacks claim white Americans are intentionally keeping them down. A case of a black man who just robbed a store and attacked a cop was shot? THIS is the best discrimination issue to showcase today? A person doesn’t want to sell cake to a KKK member? This is what SCREAMS religious intolerance through out the country? Or florist who refused to provide services to a gay couple? WELL all you homosexuals now MUST revert to being straight if the florist says so. Stores have posted forever “no shirt, no shoes, no service” forever; should the nudist now file suit against those businesses? Somehow the federal government is involved in all of these issues. Why? They created this mess why are we looking to them to resolve it. If you are looking for an answer to your problem, look anywhere except the place from whence the problem came. Focus on equality not forced acceptance. Each one of us need accept the fact someone isn’t going to like us because of something we do, believe, or at very least because of the way we appear. Someone is going to deprive of us of something that would be allowed or perhaps even deserve, if we were a little different. If you DESERVE it put the gloves on and enter the ring but if it’s a matter of “allow” just move on. Put your money somewhere else. Your rights are no greater than theirs. Stay focused, focused, focused! United we stand, divided we fall. We are falling but we don’t have to.

    When it comes to law, what is law for one person is law for another. We don’t get to pick and choose who we think gets one treatment and who gets different treatment. Either businesses have the right to refuse service to whomever they choose or they have no right to refuse service to anyone. That is how law works. What is food for the goose, is also food for the gander. Personally, I think a business owner should be able to refuse service to anyone. It is up to us to decide which businesses we choose to support.

To continue your line of thinking, why would a gay couple want an anti-gay Christian bakery owner to make their wedding cake, when there are plenty of Christian bakers who have no problem doing business with gays. There are probably plenty of gay bakers, or even gay Christian bakers, who would also love to have their business. Forcing someone to do business with someone they don’t want to do business with is silly. The market will sort itself out.

    business owner, every individual should have the right of association and ability to refuse service or refuse association with anyone of their choosing. Capitalism has a way of sorting things out. I firmly believe that Christians have the right to refuse service to anyone. So does this lady baker. I am white and I would refuse service to the KKK. The point is, if a business serves enough people to remain financially afloat, then so be it.
    Natural consequences and capitalism can sort out a lot. The federal govt needs to stay out of this. This Lady didn’t refuse service to white people, she refused service to an organization that promotes hate, bigotry and violence.
    What happened to the signs posted in most businesses that list “We reserve the right to refuse service to anyone?”

Let the owner refuse service and if she is considered wrong by the public, she will suffer monetary loss. If the KKK really wants a product done right, they should take their business to someone who supports them. (If they can find anyone) If not, they can make their own cake. But the everyone knows races is alive and well.The guy thing is that few long term white families in the South don’t have a bit of black in their blood line and that would include most the the KKK members themselves. Unintentional interbreeding, along with intentional interbreeding has been going on in the South for centuries. Even as far back as the revolutionary war and before Europeans used to chuckle about the high humber of light skinned Negros. Most slave owners had far more black decedents than white descendants. most ladies living on the plantations were embarrassed by the huber of lack kids with their husbands features on the. As they became whiter, they married back into the white families. As for white families elsewhere, unless your family is only two generations in the United States, you never can be certain how much black blood you may have in you.

    While it is gratifying to see the Left get a taste of its own medicine, we should recognize that having “civil rights laws” that are treated in jurisprudence as if they were superior to the freedom of association is both stupid and legally invalid.

    The freedom of association is protected by the Assembly Clause of the First Amendment, and it is therefore part of the Supreme Law of the United States. The civil rights laws are merely extrusions of various Acts of Congress, and these are inferior to, not superior to, the US Constitution, as amended.

    Sacrificing the freedom of association to civil rights laws, which (most of the time) are used to empower minorities and the leftist agenda, is also stupidly immoral. It compels one person to associate with another and the other’s demand, whether or not he wants to. It requires a worker to put his paid labor in the service of someone he’d rather not work for, and his reasons are, or should be, irrelevant.

    Whether I’d rather not build your house, or bake your cake, because I think your nose is too big, or because I don’t like your race or religion, or because I don’t approve of your behavior in the bedroom, is not important. What is important is this: I don’t want to work for you. I don’t want to associate with you. I should not be compelled by law to act contrary to my own will, provided that I do nothing to inflict harm on you. I should be able to conduct my own business as though you did not exist. If you want me to be your wedding photographer, and you shouldn’t, you have to know me very well to even ask. I would show up at your wedding and do as I please. You might not even be in any of the photos.

    And that’s why you should hire an actual wedding photographer…

    In the New Mexico case, the photographer told the gay couple that because of the photography businesses owners religion, they didn’t want to “endorse” that Gay couples can look happy and loving. The religions, or lack of, of the Gay couple were not brought up, that I can remember..

    If memory still serves, a refusal to serve the KKK argument was brought up, and the New Mexico Supreme Court ruled…

    A person should be allowed to use their business to serve what and who they choose. If a black store owner didnt wanna serve me because Im “white”, would I be upset? Yes. But thats no excuse for me to sue them. You have no right to not be offended. If I want, I can boycott if I so choose. I can certainly take my money elsewhere. The black store owner’s view may be wrong, but one of the things about America proper is that you have a reasonable right to be wrong. Government telling you who you must serve is just bad as telling you whom you cant serve.

    When we start chipping away at the little things we have had rights for, it opens the door for bigger things.
    If someone doesn’t want to serve you….
    People of all race’s , religions and walks of life need to shut – up and move on.
    The gay population is so small anyway, it’s not them pushing it.
    If ppl who run a business want to turn away gays, then they should turn away fornicators and adulter’s also.

I would ever be crazy enough to claim such a thing not even of our own family members that owned slaves because there would be no way to bad such a statement up.Slaves were considered property, sort of expensive livestock. They represented the major portion of a plantation owners wealth. They were not even considered to be fellow humans. I admit I cannot begin to understand the mindset that allowed this to be. But if you truly believe that you can own another human being, you are certainly to going to care what others might think about how you use your own property. We still see this attitude with how some people treat their children, girl friends and their wives. Like slavery they ail back it up using the Bible.

    It would be interesting to know if other cases test the limits of what actions the courts believe they have legitimate authority to impose on an individual.

    Can the KKK request, and the courts coerce, the baker to decorate the cake with text or images he or she finds offensive ?
    Could an african american baker raised during segregation, be forced to use his/her talent to draw a burning cross or write text praising the KKK for some particular “success” in executing their bigotry? Being denied the right to choose who to work for, and exactly what work to do is clearly an oppression of individual liberty and basic freedom.

    Here’s a solution for all bakers who wish to refuse service based on discrimination. Simply and “accidently” exchange the sugar for salt. At the most, you’ll probably have to return the money after the clients comes after you for ruining their party. Problem solved!
